The Chinese Government encourages enterprises in China and Malawi to observe international trade norms and applicable national legislation, to engage in foreign trade with integrity and for mutual benefit, and to reject any form of commercial dishonesty, including the dealing in counterfeit or inferior products. The Embassy of the People’s Republic of China in Malawi, exercising diplomatic and consular functions on behalf of the People’s Republic of China, is responsible for coordinating and facilitating the resolution of major policy and institutional issues relating to bilateral trade. It does not, however, directly handle specific trade dispute cases, nor does it intervene in the mediation of such disputes. In the event that the Malawian Party, in the course of engaging in cross-border trade with the Chinese Party, encounters a trade dispute with the latter, the party’s concerned is kindly requested to avail itself of the avenues set out below for assistance. I. Cross-border e-commerce disputes Major Chinese e-commerce platforms have established sound, efficient dispute resolution mechanisms. For online transactions via these platforms, parties shall first resolve disputes through direct negotiation with Chinese merchants. If negotiation fails, disputes may be submitted directly to the relevant platform for mediation and settlement. II.
